My landlord had to repair a clog due to old piping and problematic plumbing in our home. This happened in Feb 2008. We sent receipts and deducted from the rent even though the landlord was reluctant to pay for it. They sent us a lease a week later after being on month to month terms. The lease was dated from two months prior in Dec 2007 and included terms that tenants are responsible for paying for all drain clogs. Is this even legal? If we sign they could essentially make us pay for the plumbing bill. They are also making us responsible for their faulty plumbing.

    They can’t “make you” sign anything. But, they could evict you since you have no lease. You need to talk to them about the lease, date it currently, and discuss and agree about clogs. Landlords don’t want to pay for plumbers when tenants flush things they shouldn’t, so they have a point. You need to come to an agreement before signing a lease you both agree on , or you need to give notice and move.

    No they can not expect you to sign it if it was predated. Ignore it or you can write a letter back stating that you refuse because it is predated. If you have too get a lawyer’s opinion and let the landlord know that your talking to one. That will let him know your serious about this.

    Also if he sent you one that is with in ten days of when it arrived that means it can be legal.

    you are asking 3 questions.

    can they make you pay for drain clogs. YES and they should. This is a maintance issue.

    If the plumbing is faulty, they are responsible.

    I wouldn’t sign a pre dated lease. Yes, they could come back and make you pay for these last round of repairs.

    In addition, the lease would expire next dec 08, not in march 09.

    NO HE CANNOT MAKE YOU SIGN ANY THING, I WOULD START LOOKING FOR ANOTHER PLACE TO RENT, HE SOUNDS EXTREMELY SNEEKY AND THIS IS HIS HOUSE NOT YOURS AND HE NEEDS TO KEEP UP THE REPAIRS NOT YOU. HE WANTS HIS CAKE AND EAT IT OO ON YOUR DIME.
